TERMS & CONDITIONS
Dig Stays is a trading name of Forge Warwick Accommodation Limited (company number 14166048), registered in England and Wales. Registered office: Union House, 111 New Union Street, Coventry, CV1 2NT. Email: info@digstays.com.
These terms apply to business bookings requested on or after 7 September 2026. A quote or booking confirmation may contain additional terms for a particular stay. If they conflict with these terms, the booking confirmation takes priority for that booking.
1. Our role
We act as a booking agent for businesses arranging accommodation for employees, contractors and project teams. We source options, communicate quotes and, when instructed, arrange the selected booking with an accommodation provider on the client's behalf. The provider supplies and controls the accommodation. Its property rules and booking terms also apply where they are included in or supplied with our quote or confirmation.
2. Business customers
We accept bookings for business purposes only. The person instructing us confirms that they have authority to act for the named client and to accept these terms and the terms stated in the quote or confirmation. We do not accept a booking from an individual acting wholly or mainly outside their trade, business, craft or profession under these terms.
3. Enquiries, quotes and bookings
A website enquiry or quote is not a reservation. Prices and provider availability can change until we issue written booking confirmation. A booking becomes binding when, after the client instructs us to proceed, we confirm in writing that the provider has accepted the booking. The confirmation will identify the accommodation, dates, guest numbers, price, payment arrangements and applicable booking-specific terms.
4. Client information and authority
The client must provide accurate dates, locations, guest numbers, room or bed requirements, parking needs and other material requirements. The client authorises us to pass information needed to source and administer the booking to prospective and selected providers. We are not responsible for a mismatch, charge or delay caused by incomplete, inaccurate or late information from the client or its guests.
5. Prices and payment
The quote or confirmation states the price, taxes, deposits, payment dates and accepted payment method. Unless expressly stated otherwise, the quoted price includes the amount payable for the accommodation and our booking service. Credit or deferred payment terms apply only when approved and confirmed in writing. The client must pay each invoice by its due date. We may suspend new sourcing or booking work while an undisputed invoice is overdue and may claim statutory interest and recovery costs where the law allows.
6. Changes, extensions and cancellations
The cancellation and amendment terms shown in the quote or booking confirmation apply to that stay. They may reflect charges imposed by the provider. The client must contact us promptly when plans change. A cancellation, amendment or extension is effective only when we confirm it in writing. Extensions depend on provider availability and may use a different price or set of terms.
7. Accommodation and guest conduct
Guests must comply with the provider's occupancy limits, property rules, check-in instructions and legal requirements. The client must give those instructions to every guest. The client is responsible for charges supported by the provider's terms and reasonable evidence, including damage, extra cleaning, lost keys, unauthorised guests or prohibited conduct caused by its guests.
8. Problems, complaints and provider changes
The client or guest should report a problem promptly using the contact details in the booking confirmation so that we can liaise with the provider. For an immediate threat to safety, contact the emergency services first. If a provider cannot honour a confirmed booking, we will use reasonable efforts to source an alternative and explain any material difference in price or terms before proceeding where circumstances allow.
9. Events outside our control
Neither party is liable for delay or failure caused by events beyond its reasonable control. This includes severe weather, transport disruption, utility failure, government action, industrial disputes and a provider's unexpected closure. The affected party must notify the other as soon as reasonably possible. We will use reasonable efforts to reduce disruption and source an alternative where requested, but any replacement is subject to availability, price and the client's approval.
10. Liability
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded. We remain responsible for loss caused by our failure to use reasonable care and skill when providing our booking-agent service. We do not provide or control the accommodation and are not responsible for a provider's acts or omissions, except to the extent that our own breach of contract or negligence contributed to the loss.
Subject to the previous paragraph, we are not liable for indirect or consequential loss, or for loss of profit, revenue, business, opportunity, goodwill or anticipated savings. Our total liability arising from a booking is limited to the total amount paid or payable to us for that booking. This section applies only so far as the restriction is lawful and reasonable.
11. Privacy
We handle personal information as described in our privacy notice. The client must ensure it is entitled to give us guest information needed for the booking and has told those guests how their information will be used.
12. General terms
If part of these terms is unenforceable, the remaining terms continue to apply. A delay in enforcing a right does not waive it. No person other than the client, Dig Stays and, where applicable, the accommodation provider may enforce these terms under the Contracts (Rights of Third Parties) Act 1999.
13. Governing law and disputes
The parties should first try to resolve a dispute by contacting info@digstays.com. These terms and each booking are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction.
